Lawful Basis for processing your information

There are six Lawful Bases on which information may be processed. The four relevant Lawful Bases to us are:

  • Legitimate Interest

We can process your personal data without consent if we need to do so for a genuine and legitimate reason (including commercial benefit), unless this is outweighed by your rights and interests. The Legitimate Interest can be our own interests, and can include commercial interests, individual interests or broader societal benefits.

For us to use the Legitimate Interest basis, there is a three-part test we will apply:

  • Identify a Legitimate Interest;
  • Show that the processing is necessary to achieve it; and
  • Balance it against your interests, rights and freedoms.

When we rely on Legitimate Interest, your right to object is absolute and we will stop processing if you object. We will inform you of your right to object “at the point of first communication”, on other occasions, and in this Privacy Policy.

  • A contract between us and you: For example, to supply fundraising services you have requested. This also includes steps taken at your request before entering into a contract.

  • Compliance with a legal obligation: We may be required by law to process your data for a particular purpose. One example would be Gift Aid data.

  • Explicit Consent

Where the above three Lawful Bases are not relevant, we will seek your explicit consent before using your personal data.
